Basic treatise: If you buy a publisher's game used then you're not a customer of theirs so they don't really care if the "one time use" code thing pisses you off:

And boy did the responses start coming in:

Houses doesn't really fit in since the production cost of the house is footed by the person who first built it (and recoups most/all of it when it's first sold). The current owner of said house sort of foots the complete cost of that one instance (that one house) as long as they own it and recoups it when they sell it. Same with cars and electronics, tools, furniture, shoes, silverware and so on.
The only thing I think would come close to working out like digital products (with a high design cost and extremely low production cost) would be designer clothes or possibly books. But neither of these industries seem to have a used market that is anywhere near as big as the new market, which is the case for games and the reason (I think) that the games industry is actually suffering under it.
Also the fact that there is a giant chain doing the used trading has helped it grow incredibly fast and huge, there isn't quite the same institution for used clothes or books. And the ones that do exist don't normally sell the new stuff as well.
