People are not going to stop pirating games. If you make games and don't have a business model that can survive piracy, I don't feel sorry for you. They failed because piracy is a condition of the market. If a developer doesn't recognize that, they have failed. They had a choice to develop.
The right to a successful business is not a law I know of.
Maybe 10 years ago I would have thought like you, but piracy hasn't changed. And again, the successful companies are the ones who are creating online validation, online services, console and mobile products. Even those are not completely secure, but they are much better than a stand alone binary anyone can download.
