Bearing in mind that's a system that's had easy to install softmods out for ages. I know it's a different audience, but I still think the PS3 won't be massively affected.
Of course, publishers will be able to track PS3 piracy fairly easily cos as long as the custom fw can't be detected by PSN, users of copied games will be getting trophies. Comparing the number of users acquiring trophies against the number of copies sold when a game comes out should provide a rough guide, but of course that can be confounded by the fact that not every PS3 is on PSN and the ratio of connected to unconnected users will vary per game.
