Jeez, there sure are a lot of games coming out next week. It's only mid-September!

I don't even want to think about the flood that October and November will bring. Instead, I think I'll go play a bit of DiRT 2 and see how that turned out. Sure looks pretty.

      Bethesda is demanding the court formally declare Interplay no longer has any rights to the Fallout name or trademark. It also wants the court to place a preliminary and permanent injunction on Interplay to stop it from selling any Fallout-branded products. It also wants Interplay to submit in writing a declaration that it no longer has any rights to the Fallout brand. No monetary damages are being sought.

      TL;DR of the situation:
      When Beth bought the Fallout IP rights from Interplay a few years ago Interplay kept the (time limited) rights to make a Fallout MMO. Well skip forward to now, times up and judging by the lawsuit I'm guessing Interplay doesn't want to give up the rights they said they would.

        Yup, they were supposed to come up with $30 million, and to date all of Interplay is worth under $7 million, so there's no way they have the cash.

        Fallout 3 was a success and Bethesda has monies so I'd rather have them make a Fallout MMO than a cash strapped developer who is on the brink of shutting down completely.

      Well this is only one side of the argument, but it looks to me like Interplay is in the wrong here. They should cut and run while Bethesda isn't seeking damages.
