Fan Remake of Duke Nukem 3D in Unreal Engine 3 Authorised
by Alice O'Connor, Oct 14, 2010 6:41am PDTA group of Duke Nukem 3D fans have received the legal go-ahead for their remake of 3D Realms' classic macho shooter in the UDK, Epic's free version of Unreal Engine 3.
The plan is for the project dubbed Duke Nukem: Next-Gen to offer a shiny modern version of the shooter's three singleplayer episodes as well as multiplayer. It'll be released for free, naturally, "when it's done."
It's difficult not to be skeptical as this is a monumental undertaking but being granted a "personal non-commercial license" and the approval of Duke Nukem franchise owner Gearbox and Duke Nukem Forever publisher Take-Two is hopefully a big motivation.
The team is planning to release a multiplayer "Milestone Test" with several maps and weapons "sooner than you think."
They're also looking to round the development team out, seeking artists, texture artists, coders and animators, if you have anything to offer in those fields. This shopping list of talent is worryingly reminiscent of those posted by countless mods shortly before they collapsed due to lack of interest and skill but if the resurrection of Duke Nukem Forever by Gearbox is any indication, you should always bet on Duke.
There's naturally no word yet on when Duke Nukem: Next-Gen will be released. Duke Nukem Forever, however, is genuinely, really, truly due out for PC, Xbox 360 and PlayStation 3 in 2011. If you buy the Game of the Year edition of Gearbox's Borderlands or own Borderlands on Steam, you'll get a key for early access to the DNF demo.

I don't think Take Two has any words on this , they don't know the IP , and they are only going to publish a signle game , OLD duke stuff (everything before DNF release) is still 3DRealms property , forums reopened also.
In that kind of thing actually 3DRealms should had the word but since it's about UT3 engine and ... well is being handled by gearbox since nobody knows what going on in closed doors.
3Drealms probably asked them just because to make sure they aren't doing anyhting off record or behind gearbox back of course ... that's fine , but ... people really seem like 3DRealms is no more , yes they are and they are involved with DNF as well , vacation currently , but they are in constant touch ; there goes the stupid gaming sites saying that "3drealms closure" ... still didn't saw a year old reports that 3DR is not closing and it won't be. That's dedication and passion.

I commend the guys on their being fans, but they really can't do this. People really should know better and it really pains to have to write emails to hard working teams that picked the wrong idea.
But the level designs and the textures are all copyrighted works and you really can't go around re-creating them - even for [fun] or even for free.
Of course, I believe that the DIOQ3 guys posted before asking, and it was a straight rip instead of a recreation. But still, given that precedent, I was a bit surprised to see this UDK remake authorized.

It's not like the devs will own it in either case, and at best some lucky person will be offered a job after a year (or more) of working for free.
Hopefully the official blessing will spark a lot of interest in people joining up to help get it made. There are a lot of talented modders out there.
