On Max Payne 2, DNF

Remedy is indeed making the game just like they developed the original game, and 3D Realms will be producing again. After that, Remedy can do whatever they want as the sale of the Max Payne IP made them financially independent.
The selling of game IP rights might become more of a trend for game developers, according to Miller. " I really think this will be an eye opening deal for this industry," Miller said, adding that while he was attending E3, he ran into a number of developers who also were interesting in doing the same thing. "A lot of developers think this is ground-breaking," he said. So does that mean we could see future deals like, say, id Software selling its Quake or Wolfenstein IP rights or Epic selling its Unreal rights? Miller seems to think so. "id is a perfect candidate for this," he said.As for Duke Nukem Forever "Based on what I saw at E3, Duke is not behind the curve technology wise". Of course that can quickly change as most PC titles at E3 are scheduled to ship this holiday season with no date in sight for Duke. As for the game itself "Duke is all about interactivity and it really will be a living breathing world".

I mean, couldn't you make a game about a New York cop who lost his wife and battles drug dealing gangsters without infringing on the Max Payne IP? I'd say so given that those things are such cliches.
What else is part of the IP?
Comic book cut scenes? Even if you could patent them who gives a crap.
Slow motion? It was in the Matrix already and it was a totally shit gameplay feature anyway. Looked good; was boring as hell to use. (I want my game to get speeded up or more dangerous, like a Quad Damage, not slowed down to a boring, easy pace.)
Duke, on the other hand... That is a propper character which is worth something.

Like id or Epic would EVER sell Quake or Unreal. First off, id's already financially independant, they don't need the money. Besides, they can make more doing what they are now - letting other developers create the sequels while they retain the rights and part of the royalties. All they do is oversee the project, make sure the outside developers don't ruin their ip, and they're set. Epic's not going to sell Unreal either - it's their bread and butter.
You're only going to see this sort of thing happen with new developers who DON'T have money.

I think its obvious that 3DRealms has decided to plug in more of and more of the latest unreal engine and redo some/most/all of the character models/levels to lose the low poly, boxy look that we saw in the Duke movie from last years(!) E3...

If they sold their Quake IP to some other company like Epic or Raven or somebody, I might not even bother with the series anymore. Don't get me wrong... those companies make excellent games that are lots of fun. But they aren't id. id is like the Blizzard of the FPS world. It'd be like Blizzard selling the Warcraft IP to Westwood... WTF... it wouldn't be Warcraft anymore if it wasn't made by Blizzard.
But I can see the IP thing working for other companies though... Just not id :P

Scott had to say, "The way people misunderstand comments is stunning. I said that D3's tech was the best, but other than that DNF tech is right there with everyone else's I saw. Or perhaps the author of that article left that part out."
Plus, I think the updated Unreal Warfare engine and whatever mods 3DR have been using will produce something along the lines of Doom 3. Though remember DNF is more of a cartoon and its probably unlikely even if they used the Doom 3 engine DNF would look at "impressive." just because they style doesn't lend itself to spooky horror.
That and they could just delay DNF a few more years till they catch up. :D

Peronally, I don't require a living, breathing world in a shooter. Had this been a RPG, then I can understand. All I want is a semblence of a story, kickass level design, and better-than-average graphics, along with the typical Duke fare. They could have released a couple of damn fine Duke games in this amount of time, and I think most people would have been happy with that.
Before anyone points it out, I know Max Payne took a long time as well, and it turned out great. In fact, it's one of my all-time favorite action games (if not my favorite altogether). Duke may very well come out and completely blow us away with it's myriad of features and interactivity. It can also end up being a steaming pile, which would really be too bad. How will it end up? We may never know...

At one point it was a given that I'd buy this game, sight-unseen. After a look at an older screen shot, Its moved down a notch or two. It looks too much like SOF2, graphics-wise, and I already have that game.
I understand the screen shot is old, and perhaps the game looks much better now. In fact that's the whole point; I don't know if its any good now, where as a year ago I had no doubt.
I have decided they need to release a really good demo to motivate me to buy.
