Gearbox lawsuit puts Duke Nukem: Mass Destruction in holding pattern

The situation at Interceptor has gotten complicated over the last few weeks. Following a tease from 3D Realms and Interceptor of an upcoming Duke Nukem game, Gearbox filed suit over use of the character. Interceptor subsequently bought 3D Realms, but has been cagey about releasing more details on their upcoming game. According to CEO Frederik Schreiber and new 3DR lead Mike Nielsen, the radio silence is in direct response to the suit, even though they maintain that they've acted "in good faith."

Gearbox files suit against 3D Realms and Interceptor over unauthorized use of Duke Nukem license

Gearbox Software has filed suit against 3D Realms and Interceptor Entertainment over alleged unauthorized use of the Duke Nukem IP, stemming from a 3DR and Interceptor Duke Nukem title currently in development. Gearbox, owner of the IP since February 2010, seeks a formal injunction against any continued infringement.

A teaser site was established on February 1 with the domain alloutofgum.com, featuring a countdown clock presumably leading to the reveal of a new 3DR and Interceptor Duke Nukem entry called Duke Nukem: Mass Destruction. According to the complaint from Gearbox, the game would have released on February 25, at the conclusion of the site's countdown.

3D Realms 'voluntarily withdraws' lawsuit against Gearbox

Back in June, Duke Nukem creator 3D Realms sued Duke Nukem Forever co-developer Gearbox Software for over $1.3 million. However, it appears Gearbox has walked away the winner, with 3D Realms "voluntarily withdrawing" their claim.

"After reviewing evidence regarding our business affairs, and without any money exchanging hands, we have satisfactorily resolved any and all differences that we perceived against Gearbox," a statement from 3D Realms reads.

New Duke Nukem Forever DLC features single-player campaign; coming Dec. 13

Gearbox has revealed new downloadable content for Duke Nukem Forever, adding a new single-player campaign to the game along with a handful of multiplayer maps. The content is set to launch on December 13 on all platforms.

'The Doctor Who Cloned Me' will bring Duke "deep in the heart of Area-51" where Dr. Proton has been hatching a new, evil plan. Duke will have to contend with "evil clones, aliens queens and anything else that comes his way" in order to save the world. The announcement promises new achievements, weapons, enemies, and bosses.

Duke Nukem Forever's multiplayer-expanding 'Hail to the Icons Parody Pack' will launch next week from October 11, developer Gearbox has announced. Next week will also bring patches with "various optimizations and bug fixes" for the PC, Xbox 360 and PlayStation 3 editions.

Break out your tired and hoary Duke Nukem delay jokes, as the authorized fan remake of Duke Nukem 3D in Unreal Engine 3 has been put on indefinite hold for reasons not entirely clear. Now that we've covered that: Gearbox has announced that the recently promised patch for the PC version of Duke Nukem Forever is now available. The Steamworks-enabled title should automatically update upon the launch of the Steam platform.
