Publisher Pays for Panning Patent

In Atari's latest SEC filing, which recently showed the company in dire straits, a $300,000 settlement was revealed for a patent infringement case launched agaisnt many major publishers, including Atari. American Video Graphics L.P. owns the rights to the "method and apparatus for spherical panning" (US Pat. No. 4,734,690), essentially the means for displaying moving 3D perspectives on a 2D screen. The patent was bought by AVG in the late 90s from tech measurements firm Tektronix, Inc. In 2004, AVG filed suit against just about every company operating in the U.S. that has made games using such techniques (and which has enough money to be worth including). This includes Atari, Activision, Electronic Arts, Take-Two Interactive, THQ, Ubisoft, Vivendi Universal Games, Sega, Square Enix, Tecmo, LucasArts, and Namco Hometek (now Namco Bandai). A similar suit was also filed against Sony, Nintendo, and Microsoft for making use of the technology in its gaming consoles.

Understandably, when the lawsuit was launched in late 2004, it caused a great deal of consternation within the games industry, both among publishers and developers. Patent litigation in terms of game programming techniques has hugely destructive potential within the industry, as nearly all games make use of similar fundamental techniques that may share specific methods but are not unique to any particular publisher. AVG is clearly seeking large monetary settlements out of the matter, rather than actually attempting to curtail the use of its technology in games. A lawsuit targeting so many major publishers all at the same time would only have been launched if AVG's claims were unlikely to be stricken down.

Atari is the first publisher to have confirmed any specific action taken to end its involvement in the lawsuit.

On October 19, 2005, we and AVG executed a Patent License and Settlement Agreement pursuant to which we will pay $0.3 million in full settlement of the lawsuit, which has been accrued as of December 31, 2005, and will receive an irrevocable nonexclusive, worldwide license to use, publish, sell, etc. products conceived by the AVG patents.

Immediately after the paragraphs detailing the AVG suit, the SEC filing goes on to describe another patent suit, this one filed against Atari, Epic Games, Valve Corporation, Sierra Entertainment, Sony Corporation of Japan, Sony Corporation of America, and Sony Online Entertainment. iEntertainment Network, Inc. claims that those companies infringed on its patent describing the method for "minimizing the effects of time latency in multiplayer electronic games played on interconnected computers" (US Pat. No. 6,042,477). The companies targeted, of course, are all large entities with multiplayer network games. In this case, all the parties involved shared a combined settlement of $175,000, with each company paying an equal $25,000 portion. Each company in question was, as with Atari in the first lawsuit, granted a nonexclusive license to use the technique in its future games.

For Atari, this settlement didn't come at the ideal time; $325,000 being paid out at a time when the company plans to sell off its studios just to stay afloat certainly doesn't help. It remains to be seen how the other companies involved will react (or have reacted). Overall, lawsuits such as these--in which vast sums can be coaxed out of game companies for using techniques that have been common for decades--do paint a rather worrying picture.

F.E.A.R. Sequels Coming

GameSpot reports that Monolith is getting ready to create sequels to last year's horror action game F.E.A.R., with plans for PC and console titles. The new games will not bear the F.E.A.R. name however, as those rights are owned by Vivendi Universal Games. Monolith does still own the characters, and plans to continue the storyline from the first title.
Monolith is tailoring the sequels' content between the PC and console iterations. The practice of releasing IP on PCs first, then giving console versions a console-specific overhaul is becoming more and more common, as evidenced by Infinity Ward's Call of Duty franchise and Ubisoft's Far Cry franchise. Developers can use each platform's strengths and control schemes to deliver different experiences. Samantha Ryan, president of Monolith Productions, told GameSpot, "We believe that the PC audience is entirely viable and can support a game just as it did support F.E.A.R. To deliver the best quality title, the PC needs to be a focus. We believe that next-gen will also be awesome, but again, it has some differences and this is the approach that we're going to try."

  • Breaking News: DS Browser, TV Tuner

    Nintendo still seems to really get a kick out of jumping out of nowhere and announcing crazy stuff at keynotes and random press conferences. Anyway, in that vein, the company has just wrapped up a press conference at which several upcoming DS games and peripherals were detailed. The Advanced Media Network has coverage of the event. A more complete writeup will go up in LNC tomorrow, but in short:

    - A DS web browser from Opera is in the works
    - A digital TV tuner for DS; since this operates on an upcoming mobile TV broadcast service in Japan, it is unknown whether a similar product will come out elsewhere
    - Winning Eleven 9 for DS will use Nintendo Wi-Fi Connection
    - Children of Mana and Xenosaga I+II movies were shown
    - New Super Mario Bros. will launch in Japan in May

  • Xbox 360 Owners to Experience F.E.A.R.?

    Developer Monolith had a good year in 2005, with the release of two well-received horror-tinged first person titles: F.E.A.R. for PC and Condemned for Xbox 360. Condemned publisher Sega recently confirmed that game's upcoming translation to PCs. Now, a rumor in the latest issue of Electronic Gaming Monthly suggests that F.E.A.R. might be making a leap in the opposite direction, getting an Xbox 360 port some time within this year.

    The rumor seems largely speculative, and publisher Vivendi isn't talking, but it seems like a good fit. F.E.A.R. was a hit with both critics and gamers, and Monolith has experience shipping games on both platforms. In more general terms, the Xbox and now the Xbox 360 seem to be the console of choice for traditionally PC-focused developers. So while it's certainly not official, don't be surprised if it happens.

  • Zelda Delayed Again?

    Nintendo's The Legend of Zelda: Twilight Princess (GCN), in true Zelda tradition, was delayed last year from its holiday season release period to some time in the second quarter of 2006. Yesterday, gaming blog Kotaku reported that Best Buy had switched its release date for the game to November 2006. This fit in nicely with recent comments by Nintendo's Reggie Fils-Aime suggesting that the game might hypothetically benefit from taking advantage of the Revolution's unique controller when played with that system's GameCube backwards compatibility.

    I contacted representatives from EB Games and GameStop, both of whom stated that their release dates remain at the previously estimated June 1; they have not received any memos suggesting otherwise. I was unable to speak to an official representative of Best Buy, but information obtained from the company's retail employees and website was changed to reflect an April 1 release date. For Nintendo's part, the official answer was, "We've been monitoring all the rumors and unfortunately cannot confirm anything except it will be out this year."

    Of course, with that rumor came the resurgence of rumors that the game has been switched to a Revolution title. While it's certainly possible that Nintendo is integrating Revolution functionality in the game and may try to position it in such a way that it helps drive Revolution sales, a number of Nintendo executives both from Japan and the United States have stated that the game will in fact ship on GameCube. When that happens is anybody's guess.

  • Battalion Wars to See Revolution Sequel?

    Last September, Kuju Entertainment creative director Tancred Dyke-Wells strongly hinted in an interview that the company's Nintendo-published title Battalion Wars (GCN) might very well receive a multiplayer-enabled sequel on Nintendo's upcoming Revolution. Today, Idle Thumbs reported news from "a reliable source" that Kuju is indeed working on a title for Revolution. I'd be rather surprised if it turns out to be anything but Battalion Wars, quite frankly.

    Update: As one might expect, Nintendo has given a neutral response to this rumor: "At this time I have no confirmation of Kuju working on a Revolution sequel to Battalion Wars. This is not to say they are or they aren't, we just cannot confirm or announce either at this time."

  • Kojima Returns to Nintendo Portables

    Hideo Kojima's slightly lesser known game franchise, the Boktai series of games for Game Boy Advance, will be making the transition over to DS according to translated reports of Japanese publication Koro Koro Comic. The two GBA titles, which shipped in 2003 and 2004 to positive critical response, were notorious for their gameplay-affecting built-in solar sensors. Perhaps due to this rather inconvenient feature, the next entry in the Boktai line will eschew using natural light in favor of a graphical sun displayed on the top screen of the DS. Much like in Animal Crossing: Wild World (DS), the sun will operate based on the machine's internal clock. It will also be affected by random elements such as cloud formations and rain.

  • Datel Drives Your DS Hard

    You may remember Datel announcing its 4GB hard drive for Sony's PSP. After the device's launch, it seems Datel wasted no time in getting caught up to the other new handheld. The company has just revealed a 4GB hard drive for Nintendo DS. It seems essentially the same as its PSP counterpart (except for form factor obviously), but also includes media player software since the DS doesn't have that capability built in. Like the PSP hard drive, it's a bit pricey. Import site Lik Sang has the device currently on preorder for $179.00, a price promised to have been confirmed by Datel.

  • More Xbox Live Downloads Live

    Xbox 360 owners have some more Xbox Live Marketplace content available this week. The main entry is a demo for Ubisoft's Peter Jackson's King Kong: The Official Game of the Movie, weighing in at 575MB. Since its release, many gamers have reported a variety of bugs that were not present in the Xbox 360 in-store kiosk demo of the game. These complaints were relayed to the Marketplace team by Xbox Live's Larry "Major Nelson" Hyrb, though it is not yet known what action will be taken.

    The other Live updates add extra content related to existing titles. Stainless Games' recently released revamp of the classic shooter Crystal Quest has a variety of visual and auditory modifications available for 100 points ($1.25) each. EA Chicago's upcoming Fight Night Round 3, PopCap's Bejeweled 2 Deluxe, and Microsoft's Hexic HD each now have several themes and pictures available for purchase at varying prices.

Late Night Consoling

That CGOTE down there is dead on. Star Control had great strategy, but I never hear anybody talk about the awesome melee mode. With two players, it was great. I played it on PC, not Genesis, but you could get two people in there on one keyboard and it was awesome.
  • Special Update: New DS Revealed

    I'll have a full writeup of this in tomorrow's LNC, but for you morning LNC readers, here's a quick edit. Nintendo has updated its web page with details on a redesigned Nintendo DS system that is smaller and lighter than the original. It will go on sale March 2 in Japan for a price of 16,800 yen, or $146. The full English announcement is here. There are no details of a North American or European launch date or price.

  • Konami Announces Stuff

    Konami made a variety of announcements at its annual press event today, and here they are:

    A collector's edition DVD called Metal Gear Saga will be given to those who preorder Metal Gear Solid 3: Subsistence (PS2) starting in mid-February. The disc will include a variety of documentary content, including an interview with series creator Hideo Kojima as well as concept art and "making of" information. It also has a chronological summary of the five main Metal Gear games to date. GameSpot has a preview here.

    Konami is developing a strategy game for DS and PSP entitled Steel Horizon. The game will feature both realtime and turn-based elements, and in addition to a single-player campaign will also support local wireless multiplayer. There was no word on whether online functionality would be included.

    A few details were revealed regarding the mysterious Metal Gear B.D., the "interactive comic" project heading to PSP. It will be illustrated by Ashley Wood, who worked on the Metal Gear Solid comic as well as covers for Todd McFarlane's Spawn. Metal Gear series head Hideo Kojima and producer Noriaki Okamura will handle writing. The comic will feature animated elements and sound, as well as unspecified interactive elements.

    Konami is currently developing a DS RPG entitled Tao's Adventure: Curse of the Demon Seal. A magician named Tao must save his home from falling under a deadly curse. The game has realtime 3D models and environments on the top screen with the interface and map on the touch screen. The game will be released this March.

    In addition to Metal Gear B.D., Konami will also be producing an interactive comic-type project based on the Silent Hill franchise. It will be based on the upcoming film rather than an existing game, and will be illustrated by Steve Perkins and Alex Shibao. The UMD will also include stills from the film and games, as well as interviews with the film's crew and other content.

    A collection of the Gradius side-scrolling shooter games will be heading to PSP. It will contain Gradius, Gradius II, Gradius III, Gradius IV, and the new-to-US Gradius Gaiden. It will arrive this spring.

    Konami will be bringing a Live-enabled poker game to Xbox. All-In Poker will include five types of poker as well as various tutorial modes and online options. It will ship in March.

    Leviathan Games is working on Konami Chess Battle, a chess game for PSP that will feature some kind of story mode as well as local and online wireless play. The game will hit stores this fall.

  • Marbles Blast to Xbox Live

    The Xbox 360 may not be seeing much in the way of new retail releases, but its excellent Live Arcade service shows no sign of slowing down. Originally scheduled for a Februrary release, GarageGames' Marble Blast Ultra has appeared for download early. The game is available for 800 marketplace points, equivalent to $10.

  • Microsoft Still Backwards-Compatiblizing (Slowly)

    Various sites recently reported on "confirmation" that Microsoft has abandoned its efforts to support Xbox games on Xbox 360 for a few months. IGN, however, has received official word from Microsoft that this is in fact not the case. The backwards compatibility team is apparently still at work, but the statement given to IGN had no estimate as to when further updates would arrive.

  • Phantom Still Hanging in There, Sort Of

    Infinium Labs, the company behind perennial vaporware Phanton Gaming Service and what appears to be the more tangible Phantom Lapboard, announced that it has somehow obtained a $5M investment from Golden Gate Investors. In case you are worried that this would mean the end of Phantom jokes, however, fear not; that $5M is going towards launching the Phantom Lapboard portable keyboard/mouse package, not the console itself. Gamasutra points out that the company "has recurring losses from inception of $57,570,723, has a working capital deficiency of $10,085,662, a stockholders deficiency of $9,470,271 and has a negative cash flow from operations of $14,888,265 from inception." That along with all of the practical costs involved with launching a new system suggests we'll be waiting for the Phantom for a while yet to come.

  • Leisure Suit Larry Likely Lifeless

    GameSpot has a rumor from a former employee at Leisure Suit Larry: Magna Cum Laude (PS2, Xbox, PC) developer High Voltage Games that publisher Vivendi Universal has dropped the Larry franchise and two in-development Larry titles. Apparently, another home console game was in development as well as a PSP spinoff title. After checking with the company's VP of creative content Eric Nofsinger, the site received an official confirmation that two games from the same (unnamed) series were recently cancelled.

    Leisure Suit Larry began his life in a graphic adventure called Leisure Suit Larry in the Land of the Lounge Lizards (PC), designed by Al Lowe at Sierra On-Line. Lowe designed five more main entries in the series before the set of legal shenanigans that led to Sierra ceasing to exist as an autonomous company. Vivendi, the current owner of Sierra's huge library of intellectual property, released Magna Cum Laude--a mini-game-driven game with more in common with modern teen comedies than the relatively more charming innuendo of the earlier games--in 2004 to middling critical reception. Lowe publically expressed his frustration with the direction taken by Vivendi and High Voltage.

  • WV Slims Down With DDR

    The state of West Virginia is moving forward with a plan to outfit its public schools with Dance Dance Revolution setups. The state has one of the worst obesity rates in a country where obesity is already seen as an increasingly worrying issue. State officials hope that by providing schools with the option to use DDR as an in-school exercise method, students with an aversion to sports or other physical education activities will be more willing to stay in shape.

    West Virginia's 157 middle schools will receive copies of the game first, to be followed by the remainder of the state's 753 public schools in the next three years. The overall cost of the project is $500,000, with DDR publisher Konami donating $75,000. Oddly enough, the article says that the cost of each individual package--containing a console (likely a PS2), two or more pads, and the game--is $740. That seems a bit excessive considering the same products could be picked up at retail for well under half that.

    Keith Schofield, a music video director whose work tends to encourage being sent around the internet, has filmed a video for a band called Wintergreen; it's all about the infamous E.T. licensed Atari game. Informative!

    Perhaps you've heard about the stricter regulation on "booth babes" this year at E3. Personally, I'm rather glad about it. E3 is in many ways a big stupid circus, and the more that's done to reverse that, the better. If you need more convincing, here's a good editorial on the subject by Next Generation.

  • Star Trek Voyages to DS and PSP

    Maarten mentioned Bethesda's acquisition of the Star Trek license earlier today, but one of the games announced is console only, so into LNC it goes. Star Trek: Tactical Assault is under development for DS and PSP by Quicksilver Software, the team behind the original Star Trek: Starfleet Command (PC). It is a realtime strategy title set in the world of the first Star Trek series, and features campaigns from the Federation and Klingon perspective. The game also features local wireless multiplayer. Early screenshots are available here

    Star Trek: Tactical Assault will be available for DS and PSP this September.

  • Sam Raimi Hears the Siren's Call

    Okay, did I call this or what, seriously. Last September, I reported on a Siren (PS2) movie adaptation being made in Japan. I predicted that maybe a year after that film's release we'd see an American version being produced by a director such as, oh, Sam Raimi. Today, Variety reports that an American film adaptation of Siren is in fact being made, with Sam Raimi in the producer's chair. The Japanese version is set for release next month, and the Raimi version will be shooting this year.

    Raimi made his name with his Evil Dead series of films, and is now best known for directing the current Spider-Man movie adaptations. Rob Tapert, a frequent Raimi collaborator going back to Raimi's first film in 1978, Within the Woods, will be co-producing. The film will be written by Michael Gordon, writer of the upcoming 300, based on Frank Miller's graphic novel telling the story of the ancient Battle of Thermopylae. Gordon will work with Keiichiro Toyama, director of the original game. A director for the film has not yet been chosen.

    The Siren film will tell the story of an American med school student looking for her sister, who is lost in Japan. While searching in the village of Hanuda, she will rather unsurprisingly come upon a horrifying evil of some kind.

  • Street Fighter Alpha Anthology Arriving

    Capcom announced today that it will be compiling the four Street Fighter Alpha games plus Super Gem Fighter Mini Mix (aka Pocket Fighter) as Street Fighter Alpha Anthology. The package will contain Street Fighter Alpha, Street Fighter Alpha 2, Street Fighter Alpha 2 Gold, and Street Fighter Alpha 3.

    Street Fighter Alpha Anthology will ship for PS2 this Summer. Capcom will also be releasing Street Fighter II (not the Alpha one) for Xbox 360 via Xbox Live under the name Street Fighter II Hyper Fighting. That game is due for release some time early this year.

  • Sony Zips Up Zipper

    Sony announced today that it has acquired development studio Zipper Interactive under its recently created SCE Worldwide Studios label. Zipper is behind the Sony-exclusive SOCOM: U.S. Navy SEALs series, which has seen entries on PS2 and PSP and appeared to be the biggest draw for gamers to get online with their PS2s.

    In December, Sony purchased Guerrilla Games, the Sony-exclusive company behind the Killzone franchise, suggesting that the manufacturer might have designs to own the rest of its third party exclusive lineup. This would also include Insomniac Games, developers of Ratchet & Clank, and Sucker Punch Productions, developers of the Sly Cooper series. Other publishers, such as Midway, have also been on developer buying sprees lately. The gap between the worlds of independent development and publisher-owned development seems to be growing bigger and bigger in recent years, and with rising game production costs making it tougher for independent studios to compete in the high end development arena, don't expect it to stop any time soon.

  • 50 Cent? More like 1,000,000 Copy Sold

    Vivendi Universal Games has sent out a rather astonishing press release revealing that Genuine Games' 50 Cent: Bulletproof (PS2, Xbox) reached one million in sales during the months of November and December 2005. The statement noted that the number quoted was sell-through, that is sales to actual consumers rather than simply to retailers. What makes this so surprising is that the game was absolutely panned by critics (6.5 from IGN notwithstanding). It was widely criticized in just about every respect except for the inclusion of a great deal of 50 Cent content, which is only a plus for those who enjoy 50 Cent in the first place. The movie loosely based on the life of 50 Cent (aka Curtis Jackson), was also reviewed very poorly, yet unlike the game it didn't do as well as expected at the box office. Way to go, gamers.

  • Mother 3 Now Within Eyesight

    Mother 3, the Earthbound sequel which has seen epic delays and cancellations dating back to pre-N64 days, was recently confirmed for GBA, and all of a sudden it has a real release date. The third game in Shigesato Itoi's classic RPG series will hit Japanese shelves on April 20. There is still no word of a release outside of Japan.

  • Vivendi Aims for High Moon

    Independent Darkwatch (PS2, Xbox) developer High Moon Studios announced yesterday that it has been acquired by Vivendi Universal in an undisclosed financial transaction. High Moon, based in Carlsbad, California, was previously an internal Sammy-owned developer known as Sammy Studios. When it appeared that Sammy was preparing to close the group down last March, studio president John Rowe along with an investment group purchased all rights to Sammy Studios and renamed it High Moon. Less than a year later, Vivendi has fully purchased the studio as well as its intellectual property rights such as the Darkwatch franchise, with which High Moon has expressed interest in developing further.

    According to the press release, High Moon and Vivendi are currently working on "a soon-to-be-announced project based on a major entertainment license." Speaking to Shacknews, High Moon chief design officer Chris Ulm said that the studio has other original projects in the works as well, noting, "One of our core competencies in the studio is the creation of new worlds, concepts and characters, and I certainly expect this to continue in the future." In regards to the Darkwatch property in particular, Ulm said, "We've only scratched the surface of the Darkwatch universe. Stay tuned."

    High Moon stated that details of the unrevealed projects should be expected sometime between GDC in March and E3 in May.

  • Microsoft Quietly Revises Shipment Target

    For months, Microsoft executives staunchly maintained that the company's Xbox 360 would be able to reach 3 million units shipped within the first 90 days of its lifetime. We're now about halfway to that deadline, and most recent estimates peg the machine at 1.3M units, not significantly higher than the machine's initial launch numbers. Despite repeated claims that the machine would be shipped to retailers on a weekly basis, demand doesn't seem to be close to sated.

    Now, it seems that Microsoft has revised its earlier estimate to a new goal that's at least slightly more long term. Rather than 3M by the end of February, Microsoft is now aiming for 4-5.5M by the end of June.

    The fact that Microsoft hasn't extended the goal date by all that much speaks to the company's confidence in the newest addition to its manufacturing chain. At the company's keynote at last week's CES, it was announced that electronics manufacturer Celestica has been brought on board to make additional Xbox 360 consoles.

  • Video Games Live to Live Again

    Video Games Live, the nationally touring symphonic concert featuring video game music from throughout gaming history, was cancelled last year, but today the International Game Developers Association sent out an email to members announcing the first of what is hopefully a new run of shows. It will coincide with the last day of the Game Developers Conference on March 24 in San Jose. Pre-order tickets are on sale for GDC community members. General public ticket sales begin January 16.

  • Oblivion to Span One Disc on 360

    A Bethesda developer has confirmed via The Elder Scrolls Forums that the Xbox 360 version of the company's upcoming The Elder Scrolls IV: Oblivion (X360, also PC) will be contained on a single disc. There had been prior speculation that the game would require multiple DVDs due to the high amount of content and high resolution textures inherent to next-gen gaming. For example, From Software has stated that its upcomgin 360 RPG, [eM] -eNCHANT arM- (X360) will require multiple discs, though that is predominantly due to the traditional heavy use of pre-rendered CGI in Japanese RPGS. Many used this as a condemnation of Microsoft's decision not to use a next-gen optical disc medium in Xbox 360 as Sony is doing with Blu-ray in PS3.

    According to MrSmileyFaceDev at the official forums, though, it won't be a problem for Oblivion. In response to accusations that the game would require four discs, he stated, "No, the game will be on one disk."

  • Chaos Theory Maps Fixed, Sort Of

    Last August, Ubisoft released some new maps for the Xbox version of Splinter Cell: Chaos Theory (PS2, Xbox, GCN, DS, PC) over Xbox Live. Unfortunately, it turned out they were horribly broken and Ubisoft disabled them. Finally, it seems that the maps are available again, but now that they're working on the Xbox, they don't seem to be working when the game is played on the Xbox 360. Microsoft's 360 backwards compatibility list added Chaos Theory in the last update.

Where Has All the Innovation Gone

GameSpot has a fairly long editorial up called Bitter Medicine, asking "What does the game industry have against innovation?" GameSpot's usually not the type of news outlet to take sides or display strong opinions regarding this sort of thing, so you know that when they have this kind of article up, the problem is pretty severe. Just to be clear, when GameSpot says "innovation" it's frequently better to substitute "uniqueness" or "originality." The chief example given in the article is Double Fine's Psychonauts (PS2, Xbox, PC), which isn't innovative so much as it is incredibly unique and creative. It seems that uniqueness and creativity are simply not what's wanted in the games industry; Psychonauts designer Tim Schafer, responsible for titles such as Full Throttle (PC) and Grim Fandango (PC), said that when shopping Psychonauts and now his next game around to publishers, he actually had to downplay the creative aspects to even get them to look at the games.

"Inovation's dead, dying. Every once in a while, somebody will slip something in that will shock us, but for the most part there's no money in innovation, even if it's great," said Wedbush Morgan analyst Michael Pachter. "Now we've got how many more World War II games coming out?" Michael Pole, an executive vice president at Vivendi when Schafer was doing Psychonauts, said he badly wanted to work with Schafer, but the greenlighting process at publishers is simply not conducive to products that are so different. Psychonauts did get picked up by Majesco, but essentially bombed at retail despite plenty of positive press and gamer anticipation. Schafer thinks part of the problem is how the retail system works. Even right at the game's launch, there were indeed many reports of the game being simply impossible to find because stores either didn't order any copies, or only ordered enough for the meager preorders. I made similar observations in a Shack editorial.

"There are a lot of things about the film industry we kind of aspire to, like some of the funding models that give more control to creative talent, innovative financing and things like that," Schafer says. "But there's a part of me that also looks at the film industry and [sees] it's not super great right now, either. It's not a hotbed for innovation either. But it does have an independent film machine that's viable, and that's something gaming doesn't really have. In film, you can have the independent movie win best film of the year at the Oscars. But there's not really a chance that one of those indie games is going to knock out Halo, you know."

Pole also likens the situation to film, comparing the current games industry to old studio-dominated Hollywood, in which directors simply made movies on demand to fit market-researched specifications--much how the current publisher/developer relationship works now. Companies like Elevation hope to give more control to developers while still maintaining financial security, but that endeavor has its own set of problems. Will the situation improve like it arguably has in film? Maybe, but let's hope it doesn't take half a century this time.

Silver Lining for Fan Project

For several years now a web-based team has been working on an unofficial sequel to Sierra's classic King's Quest series. On September 29 the project, called King's Quest IX: Every Cloak Has a Silver Lining, was hit with a cease and desist order from Vivendi Universal. Though Sierra no longer exists as a physical company, Vivendi owns the studio's name and properties. Shutting down the project isn't all that surprising, as similar actions have been taken in the past against fan projects, but what is particularly notable is that after apparently thousands of emails sent to Vivendi regarding the situation, the team announced today that the company has granted a license to allow development to continue. The "King's Quest" part of the name has been removed, presumably so there is no confusion as to whether it is an official product, but the actual world and characters remain intact. The team's press release included part of a statement from Vivendi:
"After extensive evaluation, Vivendi Universal Games is pleased to announce that the fan developed trilogy project 'The Silver Lining' (previously known as King's Quest IX: Every Cloak Has A Silver Lining), based on characters from Sierra Entertainment's 'Kings Quest' series, has been given approval to continue development. We look forward to seeing the first of its three upcoming chapters, 'Shadows', completed soon." [Note: Though Vivendi's permission was granted November 29, it was only announced today.]

The team notes that given the prior assumption that development was going to halt, the game has been somewhat delayed, but should still surface in 2006.

F.E.A.R. SDK, Dedicated Server Files Released

Vivendi Universal Games sends along the F.E.A.R. SDK, allowing you to create custom singleplayer and multiplayer content for Monolith's first person shooter. Also available are Linux and Windows dedicated server files. More post launch support will follow
VU Games is also pleased to announce that as part of its ongoing efforts to improve the in-game experience for gamers, a deal has been signed to incorporate the Punkbuster Anti Cheat software into F.E.A.R. . Other updates planned for 2006 include additional multiplayer maps and game types, along with a "votekick" option.

Trilogy Studios Formed

GameSpot is reporting on Trilogy Studios, a new development company formed by fformer Electronic Arts Los Angeles executives Mark Skaggs (Command & Conquer franchise) and Rick Giolito (Medal of Honor franchise) and former Vivendi Universal executive vice president Michael Pole. According to the GameSpot, the startup's first game will be a "first-person shooter/RPG combo" using the Unreal engine. Trilogy will develop for next-gen consoles and the PC.
Trilogy will be funded through independent financing--neither publisher-backed nor VC-backed. Pole sees numerous alternatives, some being floated by those familiar with film financing and others with even less pedigree. According to Pole, "We are 100 percent focused on next-generation property creation. Our core team is building ideas and prototypes now, and we are establishing partnerships and generating the necessary resources to produce the highest-quality games for next-gen platforms." Giolito added, "For us, it's all about what's the best way to make new creative gameplay, new game ideas, and new IP that people want to buy."

Hey there. I've got some news for you.
  • Mysterious Mana Game Heading to PS2

    For some time it has been known that Square's World of Mana project would encompass at least two games. Recently, one of those games, Children of Mana, was confirmed as heading for the Nintendo DS. Now, it seems that the platform for the other game is the PlayStation 2 (IGN oddly reports that the news "would have been a surprise had it not been totally expected from the start"). Currently without a subtitle, Seiken Densetsu 4 (PS2) still has few confirmed details and no screenshots save some colorful and very Mana-esque concept art.

    There is not yet a projected release date for the game. Children of Mana (DS) is expected to ship in Japan next spring.

  • Xbox 360 to Undercut PS3 by Half?

    Merrill Lynch has broken down the manufacturing costs of Xbox 360 and PS3 based on their hardware components, as well as predicting where the costs will fall three years after launch. The firm puts the launch manufacturing cost of a PS3 at approximately $495, with the Xbox 360 (including the hard drive) at $340. The biggest contributors to the discrepancy are Sony's Blu-ray drive, at $100 to $25 for 360's DVD drive, and Sony's Cell processor, at $160 to $100 for 360's PowerPC processor. PS3 also includes features such as Bluetooth ($10) which are not present in Xbox 360.

    The report states that PS3's cost disadvantage indicates that "the Xbox 360 could be selling at half the price of PS3 in the latter half of 2006." In addition to lesser initial costs, most of the components Microsoft is using in its console are fairly common in the industry, whereas many PS3 components are either proprietary or less widely used. For example, the GDDR3 RAM used in the Xbox 360 is more openly available on the market than the XDR RAM used by the PS3 (the PS3 splits its 512MB of RAM between GDDR3 and XDR).

    Of course, the report also assumes that Sony will be aiming to avoid taking a financial hit on each console it sells, either at launch or soon after. If Sony is willing to take a loss, it of course would be able to price the PS3 more competitively. However, Sony--the worldwide parent company, that is--has been floundering financially, and with the PlayStation family currently being one of its few divisions operating on profit, it seems unlikely that management would choose that route. In reality, it probably depends largely on Microsoft's success with Xbox 360. If Sony feels that Microsoft's head start is not enough to significantly impact Sony's market share, it will likely price above cost; if Microsoft's new console performs better than Sony anticipates, it might need to take a more aggressive stance.

  • An Xbox 360 Game is Done!

    Though a final-final super-approved official Microsoft launch list for Xbox 360 has still yet to surface, gamers planning on picking up the upcoming console can now rest assured that they will have at least one game to play, barring any bizarre manufacturing or shipping mishaps. Sega has announced that Monolith's Condemned: Criminal Origins (X360, PC) has gone gold, and will be shipping alongside the 360 on November 22. Monolith most recently shipped the critically-acclaimed shooter F.E.A.R. (PC).

    Adding weight to widely-accepted reports that non-budget third-party Xbox 360 games will retail for $59.99, the first widespread major price point increase for standard video games (ie., not special editions or limited runs) in decades, Condemned will in fact retail for $59.99.

  • DS Wi-Fi Bounty Collected

    Stephen Stair has claimed the first part of a public bounty to crack the wi-fi implementation of the Nintendo DS for use by the homebrew community. The first half of the bounty, currently $1484.22 of $2968.45 but still open to further donations, was awarded to him for being "the first person to document the DS WiFi registers." The remaining half of the bounty is further split in half for achieving each of two more goals: the first implementation of working connect and transfer code, and the first TCP or UDP stack. Stephen has already demonstrated that his code will connect to a wireless router, and states he is currently 90% done writing his own TCP stack (plans to use an open-sourced stack failed due to various complications). The development is good news for the DS homebrew community, which has software such as an IRC client and an RSS reader largely ready to be finished once the code is complete.

    Apparently not content with this development, Stair has also begun work on a wi-fi tunneling project for DS, which will allow multiplayer non-online DS games to be played over the internet. The page is accessible only by way of a simple riddle of which I have decided to deprive you. Announced publically only today, Stair expects the project to hit a private beta phase in a week or earlier. I'm sure I can speak for other owners of Advance Wars: Dual Strike (DS) when I say my head is currently in the process of exploding.

  • The Simpsons and EA

    EA has announced its acquisition of the rights to develop and published games based on long-running animated television show The Simpsons. Previously, the rights were held by Vivendi Universal, which published Radical Entertainment's extremely commercially successful (and somewhat critically successful) The Simpsons: Hit & Run (PS2, Xbox, GCN, PC).

    EA Redwood Shores Studio vice president and general manager Nick Earl stated, "This is something EA's been interested in for years and now game development and technology is at a place where The Simpsons characters and world will really come alive in these games." The Simpsons executive producer James L. Brooks stated, "I think this is a great opportunity for us, primarily because it brings with it the possibility of free EA games." He did not specify whether, in other circumstances, he would pay for EA games.

    The first EA-published title under the agreement will be developed for next-generation consoles. No release date was given.

  • September Sales Charts Released

    The video game sales charts for September have come in, and it was apparently quite a good month for sports--and, by extension, for Electronic Arts. Of the top 20 bestselling console games, half were published by EA, and eight were EA Sports titles. The other two sports titles to make the list were Namco's Mario Superstar Baseball (GCN) at #3, published by Nintendo, and Yuke's' WWE Day of Reckoning 2 (GCN) at #8, published by THQ. Not surprisingly, EA's Madden 06 (PS2) came in at #1 again, with various other platform versions of the game also appearing on the list. All three versions of Nintendo's Nintendogs (DS) stayed present, at #9, #13, and #16, though it is not clear what their combined ranking would be; all three titles contain the same content. The debut of Criterion's Burnout Revenge's (PS2, Xbox), published by EA, saw the Xbox version outselling the PS2 version considerably, hitting #10 for the former and #18 for the latter. Finally, Game Freak's Pokemon Emereld (GBA), published by Nintendo and on the charts since April, seems to be finally slowing down, as it moved from #6 to #19.

    Business Week online has a chat with Nintendo design head Shigeru Miyamoto. Despite some bizarrely erroneous information by Business Week in the opening paragraph, Miyamoto's remarks on his design process are great reading. His comments on the genesis of Pikmin (GCN) and Super Mario Bros. (NES) are particularly fascinating.
