Richard Garriott Sues NCSoft for $27 Million

May 06, 2009 12:11pm CST tags: NCSoft, Richard Garriott, Legal, Lawsuit
Ultima creator Richard Garriott is suing former employer NCSoft for around $27 million, alleging he lost stock options when the Tabula Rasa publisher mischaracterised the circumstances of his depature, GamePolitics reports.

"I am leaving NCsoft to pursue [other] interests" wrote Garriot in an open letter when he left in November 2008, making his depature appear voluntary when this was not the case.

While in quarantine following his voyage into space, Garriott was informed by telephone that his employment was terminated despite his protestations, the suit alleges.

Had Garriot's employment been terminated, his stock options would have lasted until 2011. Instead, presented as voluntary, Garriott's options expired after 90 days and he sold into "one of the worst equity markets in modern history", losing "tens of millions".

Garriott seeks to recover damages, interest and legal fees for his claims of breach of contract, fraud, and/or negligent misrepresentation--totalling around $27 million.

Champions Online Testers Poached From Rival

Cryptic Studios has confirmed that it recruited players for the now-underway Champions Online closed beta from super-powered rival City of Heroes and other PC MMOs.

Rumors of such practices emerged via Massively earlier this week, after the official City of Heroes website warned players and forum-goers of solicitations from "another game company trying to lure you to their competing product."

Left, Champions Online. Right, City of Heroes.

While Cryptic Studios was initially involved in the creation and upkeep of City of Heroes, the company later sold its stake in the franchise to publisher NCsoft. Cryptic then revealed Champions Online a few months later, and was later bought by Atari.

"I'm certain this wasn't meant to be a malicious attack on a competing product, nor did anyone intend to steal players, violate user agreements, kill babies... Read more

Worlds Claims MMOs Infringe 'Virtual Space' Patent, Sues NCsoft

Dec 29, 2008 4:58pm CST tags: MMO, NCsoft, Worlds, Lawsuit
Self-described pioneer in "3D virtual communities and rich immersive environments" Worlds has sued MMO publisher and developer NCsoft for infringing on a Worlds-held patent titled "System and Method for Enabling Users to Interact in a Virtual Space."

The lawsuit claims that by developing and selling massively multiplayer online games--including City of Heroes, Dungeon Runners, Tablua Rasa, Lineage, Lineage II, and Guild Wars--NCsoft "directly and/or contributorily infringed" on Worlds' patent.

Filed in 2000 and granted in 2007, the broadly-worded patent "provides a highly scalable architecture for a three-dimensional graphical, multi-user, interactive virtual world system" that uses a "central server" to compute the positional data that allows avatars to interact with each other as well as the environment.

Curiously, one of the titles listed in the lawsuit--Lineage--was initially released in 1998, almost two years before Worlds filed for the patent that the game supposedly violates.

Furthermore, the patent could be theoretically applied to just about any online game ever, prompting speculation that NCsoft is only the first up against the wall. Blizzard is a likely target, given the success and 11.5 million subscribers of World of Warcraft.

A specific sum was not named in the suit, which was obtained and distributed by Virtual Worlds News. Instead, Worlds is simply demanding that its patent be found "valid and enforceable" so that it can get a "permanent injunction" against NCsoft and receive unspecified compensation for the damages it has suffered.

NCsoft Consolidates MMO Devs, Creates NC West

Korea-based MMO publisher NCsoft today announced that it will consolidate subsidiaries NC Europe, NC Austin (Tabula Rasa) and ArenaNet (Guild Wars) under the leadership of a new company titled NC West.

While the old studios will not be closed, a new office in Seattle will be established for NC West, which will then lead the companies as a unified organization. NC Interactive's Chris Chung was named as CEO of NC West, with Jeff Strain taking up the presidential mantle.

"We are confident that by combining our subsidiaries into a unified global organization under Chris Chung's leadership, NC West will become a more powerful force to be reckoned with in the western MMO market," said CEO Taek Jin Kim.

Earlier this year, NCsoft cut 21 employees from NC Austin following the disappointing sales of the studio's MMO Tabula Rasa. GamesIndustry reported yesterday that NC Europe may soon lose 50 employees following the halt of production on the studio's unannounced MMO.

NCsoft Launching Gamer DNA into Outer Space with 'Digital Time Capsule,' Could 'Resurrect Humanity'

Jul 30, 2008 11:07am CST tags: Tabula Rasa, NCsoft
Richard 'Lord British' Garriott When Ultima and Tabula Rasa creator Richard Garriott ventures into space this fall, he will deposit a "digital time capsule" on the International Space Station that packs the digital DNA of certain Tabula Rasa (PC) subscribers.

Dubbed Operation Immortality by publisher NCsoft, the capsule will contain "the digitized DNA of select video game players and space aficionados" along with copies of all active Tabula Rasa characters as of September 2, 2008.

"I've been able to do some very exciting things in the games business, but nothing of this magnitude," said Garriott. "A select few will have their DNA digitized and sent. And, theoretically, if anything happens to the human race, it could be their DNA that is used to resurrect humanity."

The promotional campaign extends to those who don't play Tabula Rasa, with OperationImmortality.com hosting online polls regarding humanity's greatest achievements, though only active Rasa players will have the "chance" of their DNA being sequenced, digitized and sent into space for all .

MMO developer NCsoft today announced a new partnership with Double Fusion to supply in-game advertising for City of Heroes, releasing several images of the game world before and after ad integration.

The companies say that the real world ads will lend a sense of realism to the super-powered world of City of Heroes, with players able to opt out of the advertising if they so choose. Additionally, NCsoft plans to make use of the technology to display player-created content within the game.

"We are pleased to work with Double Fusion on City of Heroes," said NCsoft general manager Brian Clayton. "[T]hey have demonstrated sensitivity to the needs of our community and fundamentally understand how advertising can bring value to the players when executed gracefully, and in the appropriate context."

NCsoft acquired complete ownership of City of Heroes last year from original developer Cryptic Studios.

Double Fusion recently signed a similar deal with developer Gearbox Software, which plans to use Double Fusion's technology to bring in-game advertising to an undisclosed roster of upcoming titles.

NCsoft is currently working on a new Lineage (PC) title, and late last year announced the acquisition of the City of Heroes property from series creator Cryptic Studios.
