Nintendo announced that it has secured another legal victory today, after a Maryland US District judge dismissed a patent infringement suit against the company. The suit from IA Labs CA, LLC had alleged that various Nintendo products including Wii Fit, Wii Fit Plus, and the Balance Board accessory infringed on one of its patents.
"We refuse to succumb to patent trolls," said Nintendo's senior VP of legal & general counsel Rick Flamm.

Guitar Hero III is the best selling video game of the "current generation," according to market research firm NPD Group's retail-only data. The top-ten games are revealed over on CNBC.

Although some companies achieved sales milestones in 2010, including Activision's Call of Duty: Black Ops and Microsoft's Xbox 360 console, sales throughout the industry were down "as much as 1 percent when compared to 2009," the NPD Group estimates.
Data is still preliminary for "total consumer spend on gaming content via all monetization methods, including new physical video and PC games, used games, game rentals, subscriptions, digital full-game downloads, social network games, downloadable content, and mobile game apps," however, the market research company puts complete spending between $15.4 and $15.6 billion. Last month, the Xbox 360 sold more hardware than any other system for the first time since 2007. Microsoft managed to pull it off again posting a second straight month of topping the hardware sales, though overall sales were down month to month. The PlayStation 3 was the only console to show gains versus the prior month, but has still not returned to its June sales of 304.8K units. The Wii posted its lowest hardware sales since launch.

NPD group has revealed the sales data for June 2010 and Red Dead Redemption continues to own the top of the charts. Claiming first on the Xbox 360 for the second month in a row and third on the PS3 (down from second place in May), Rockstar's title continues to dominate critical and commercial reception. Sadly, these figures come a day following word that the San Diego team behind the rebirth of the virtual wild west saw job cuts. Mario's second galaxy hopping adventure pushes into second place, while Toy Story 3 (NDS) and Lego Harry Potter: Years 1-4 debut and Remedy's Alan Wake (unfortunately) falls from the top ten. On the hardware side, the Xbox 360 (thanks to its new slim model) saw the largest gain of 257.1K units to take second place away from Nintendo's home console.

Nintendo and the American Heart Association have joined forces to help people "create healthy lifestyles through physically active play," the unlikely duo announced today.
The "multifaceted strategic relationship" will include a website extolling "the benefits of physically active play," a study to "take a closer look at the synergies and potential benefits of active-play video games and physically active lifestyles" and slapping the American Heart Association logo on Wii, Wii Fit Plus and Wii Sports Resort boxes. Kicking off new year with self-congratulatory press release, Nintendo began today by listing off some of its accomplishments in 2009, such as its estimate that the Nintendo DS "set a new all-time calendar-year U.S. sales record for any console or hand-held."
The company further boasted that the Nintendo DS represents the "best selling videogame console" in European history with over 40 million sold across five years, with the Wii having sold just over 20 million in the territory across three years. Read more »

Nintendo today announced that its "enhanced" exercise title Wii Fit Plus will be on North American store shelves Sunday, October 4.
Plus brings with it a variety of new activities, along with the ability to create a custom routine.
Nintendo says that the $99.99 Wii Fit Plus/Wii Balance Board bundle will "replace" the $89.99 Wii Fit bundles already at retailers. Read more »

As expected, Nintendo announced Wii Fit Plus this morning during its E3 press conference, a follow-up to the popular exercise software.
Six new strength and yoga activities will be included in the game, in addition to fifteen new balance games. Users can now combine the exercises in any order they want, and omit any interludes between the exercises. The title will also keep track of the total number of calories users burn while exercising.
