It's my understanding that it's not really a binding contract if there was no room for negotiation. Just have you click a button that says "I agree" is not strictly a contract.

What if the person who clicked "I agree" was not of age to enter a legal contract? There are many ways...
The fact is the way they word these things no normal person is ever going to read through them.
