Somehow I don't think Wal-Mart et al are going to give Activision, EA and Nintendo too much flack about stocking their 5-piece band and board plus RV packs--XS Games just happens to be a microscopically small publisher so they're a bit easier to stiff arm and/or freeze out completely with little-to-no hit to the bottom line.
