I think SK is going to have a hard time winning this case. Perhaps Epic did screw up and the UE3 source was delayed. Their basis for this lawsuit is that Epic purposely did it to gain commercial success. SK is going to have to prove this in order to win. I'm positive even if their were problems with the engine, it was unintentional on Epics side of things and SK is just reacting from bad press from the showing at E3.
