Shacknews and FileShack are not liable for any costs, expenses, losses, or damages, either general, special, actual, consequential, or incidental, that you may suffer or that some other person may suffer and claim against you resulting from the following: use, misuse, or service outage; customer premise hardware; your actions or activities, whether legal or illegal; the actions or activities of any other Shacknews or FileShack customer, whether legal or illegal; or any other goods or services provided by Shacknews and FileShack or any of its vendors. In no event shall Shacknews or FileShack be liable to you under this Agreement or in relation to any matters in any way connected with this Agreement in an amount that exceeds the service fees you have paid in the preceding year.

Other than as specifically described in these Terms of Service, Shacknews and FileShack makes no guarantee or warranty of any kind. Shacknews and FileShack do not warrant or guarantee that its service is fit for your particular purpose. Shacknews and FileShack do not warrant or guarantee that its service meets any implied warranty of merchantability. Shacknews and FileShack do not warrant or guarantee that its service meets any other implied warranty or guarantee and specifically disclaims any other implied warranties or guarantees.

The Mercury billing system is automatically renewed each month (for $6.95) until a user cancels their account. If a user purchases an extended six month or one year plan, at the end of the initial order billing will auto-renew for the same period. A customer may cancel his or her account at any time. There are no refunds or pro-rated refunds.

Shacknews and FileShack retain the right to cancel your account at any time. Mercury service packages are sold and intended for individuals and not to be shared.

The Shacknews and FileShack terms of service agreement may change at any time without notice. Visit this page periodically for updates.

Content Control

Shacknews and FileShack do not and cannot control the content of files downloaded from the FileShack network. Shacknews and FileShack are not responsible for any damages, direct, indirect, incedental, or exemplary incurred by downloading or installing packages from the FileShack network.

Fees And Payment

Shacknews and FileShack will charge you for access to the Mercury subscription plan. By submitting the subscription form you agree to pay all fees including applicable taxes incurred. Shacknews and FileShack reserve the right to modify the basis of the fees and how they are calculated.

If a Mercury subscriber cancels for any reason, service may be terminated immediately upon the date of cancellation.

Refunds are not offered by Shacknews and FileShack except for in cases of fraud. Shacknews and FileShack are not responsible for accounting errors if they are not claimed within 90 days.

User download habits are tracked by Shacknews and FileShack to determine popularity of particular files and genres to enhance the end user experience as well as protect from abuse.

Due to the nature of the Internet, Shacknews and FileShack can not make any guarantee of quality of service. Service is provided 'as is' and 'as available.' No warranties are given or implied.

No instructions or information given on Shacknews or FileShack give any warranty of any kind and do not supercede the Terms of Service.

Any prizes, gifts, or contests held for Mercury subscribers are void where prohibited by law.
