Shame On Nike
by Steve Gibson, Jun 29, 2000 9:11am PDTJust when you thought getting web traffic was a good thing, this guy is wanting to file a lawsuit against Nike.com because they made it so easy for Nike to get hacked and traffic was sent to his website. Mr. Smith isnt going after the hackers though, but going after Nike for negligence. (Thanks rage)
"Some might say the hacker or hackers are/were responsible," Smith wrote in an angry note on a self-created website called Shame on Nike. "To a small degree that might be true. However, Nike must surely bear the responsibility, since it was their total lack of security that allowed it to happen in the first place.

"In this case, it would appear that our system was breached and that it became possible for someone to perform the functions needed to receive the www.nike.com referral and pass it onto the server hosting www.s11.org."
ok, with his mentality, Nike could in effect sue him, for having poorly set up security, and for allowing thier domain to be pointed at his. if i were nike, and dealing with an ass of this magnitude, i would certainly be filing charges.... =p
surprised hes not from america, considering thats our constitutional motto.....
If your stupid, please do not have children so you can't spread your stupid genes.
"Some might say that the hacker or hackers are/were responsible. To a small degree that might be true. However, Nike, Inc. must surely bear the largest responsibility since it was their total lack of security that allowed it to happen in the first place."
Hey wait, I thought it was the *hacker* that did the damage...Nike was a victim too. Since when has a victim been more responsible for a crime than the criminal?
"We believe we took the path of least resistance (to mitigate our losses and damages) by allowing the initial referral and by diverting the traffic back to Nike on their request."
He didn't have to do this. He knew at that point what kind of traffic he would have to handle by doing something like that. Why not simply block the DNS lookups? The fact that his nameserver doesn't know the Nike info would propagate to other nameservers, afaik, and the problem would take care of itself. Nike's NSI DNS entries being screwed up is Nike's problem, not his.
The nice thing for Nike to do would be to reimburse this guy for the massive redirection traffic he had to handle for Nike. But they don't have to. By hooking up your computer to the Internet you take risks; as an ISP operator this guy knows that. It's sad that many people can't simply accept that they acted stupidly, and instead become whiny bastards and blame everyone else.

In no way are they fully liable, because the hacker has to be at least a wee bit liable... doesn't he/she?

Who the hell would go there instead of to a porn site or something?
Fuck Fuck Fuck! Fuck!
I called my local software shop about an hour ago asking if Diablo II was in yet, they said they had the collectors edition, and that they'd hold one for me, so I went on my jolly little way to pick it up. Lo and beyold, when I got there, the fucking crosseyed store manager had sold of my copy. Needless to say, I am quite enraged. On top of that, the guy in front of me in line got the last copy, prolly in all of montreal since that was the only store carrying the collectors edition. Ya, so Im pretty fucking pissed off now. Fuck.

My god, think of the precedent. Now, if someone can bust into a site, it's that site's fault for whatever happens [as leaving even the smallest security hole can be "negligent"].
And after reading the story, you know the guy does have a point from what I read...
When I read what Steve wrote, I kinda got the impression that the h4ck3r was suing..
But it was the guys business, so it's not that zany, really.
