Napster vs Offspring

We're pretty much done with the whole Metallica/Dre/Napster thing around here but this one was too good to pass up. It looks like Napster has sent a legal letter (more info here) of their own against Offspring (the music group). Offspring has been noted previously as a voiced support of Napster and MP3 trading online. Here ya go:

...to the Offspring with a legal order Friday (June 2) to stop selling merchandise imprinted with the Napster logo, [snip] "It's all fair," an Offspring source said on Thursday. "We've already said you guys [can use] our stuff we're gonna do yours, too. You shouldn't have any problem with that, should you?"
Quite amusing. Here is the Offspring website where they are selling the 'bootleg merchandise' 6pm update: FreshView dug up this update on MTV.com with word that they have reached an agreement.

  • I'm with Freshview, although both he and CatTurd made valid and interesting points (thought I don't agree with mocking someone's beliefs CatTurd.)

    The way I see it is this:

    Napster will lose in the eyes of a judge because although they have a disclaimer saying thier software is not to be used illegally, they are in fact knowingly allowing users to commit a crime, and are not actively trying to disuade or even prevent such actions from taking place.

    Even if Napster are not forced to cease providing thier service, they will be required to either a) police the traffic that thier software generates, or b) ban all users that are known to trade copyrighted material and cannot prove they own the original recording.

    Of course either outcome will result in Napster being unable to continue because we all know that illegal mp3's account for a good 99% of all Napster traffic, and without that volume of traffic they will recieve no revenue.
