West and Zampella suit going to trial
Jason West and Vince Zampella's case against Activision has been given permission to move forward by a Los Angeles Superior Court judge. Unless a settlement is reached, it should go to trial later this year or early next year.
Former Infinity Ward members Jason Ward and Vince Zampella have been given permission to go forward with their lawsuit against Activision. Hollywood Reporter gives word that a Los Angeles Superior Court judge approved a trial detailing the controversy surrounding the release of Modern Warfare 2. This doesn't mean a ruling in their favor, however; merely that the case has enough merit to go to court. The trial is likely to begin later this year or early next year.
This is just the latest bit of drama surrounding the case. Activision filed a counter-suit against West and Zampella, then added EA to the suit to the tune of $400 million, alleging that the company was complicit. This claim was later supported by incriminating e-mails, which EA spokespersons shrugged off as a joke. More recently, West and Zampella added fraud charges for assurances of creative control and job security.

this allegations are solely on part of activision and nobody of the old team has confirmed it, furthermore now that zampella and west are gone nothing should hinder the payments, yet apparently nothing was paid.
while i'm sure that both sides are full of shit i appears to me that activisions claims on this particular issue are less plausible than you make it out to be.-
If they planned to encourage their team to leave after payment, then where is the evidence? Besides forged emails ofc. Those are all the rage nowadays.
More likely, the duo's actions may have suggested that something like that would happen, but then using that as grounds for termination and withholding payment due isn't just.
Yeah, if I completed a project in which I would earn $36,000,000 sure I might be likely to change a few things in my life after that, perhaps start my own team, but then my employer deciding to fire me so that it won't be possible? Lawsuit time.
I hope Activision is forced to pay everyone what they agreed to plus interest and damages.

Well this at least explains why MW2 was so unfinished, and why MW3 looks like shit/ a carbon copy of MW2. The two masterminds behind the best CoD so far (4:MW) left during MW2's post production and the left over guys had to finish their creation without really knowing how to do that.
It would be great if this lawsuit ended with W&Z getting full control of the Call of Duty series again, and making MW3 the way that they want to. Too bad that will probably never happen. -
Time has left them all behind. MW3 has been blasted as more of the same.I haven't bought it as MW4 was the last that was any good. Black Ops just boring really.Whoever gets to run the show,will be lumbered with a has-been title. Duke Nukem should be sent to sort em out ASAP!
