According to the terms of the probation, May must "stay in school, not reoffend, stay off of Xbox Live web sites, and forfeit his computer, which was seized at the time of his arrest" for 18 months. If he does this, the case will be dropped.

May was reportedly spotted downloading code from the game onto his laptop at PAX East before being caught and arrested. Later, he failed to show up for his court arraignment and a warrant was issued for his arrest.
