OutRun Online Arcade Being Pulled From Sale
by Alice O'Connor, Oct 12, 2010 10:00am PDTSumo Digital's downloadable Ferrari racing game OutRun Online Arcade has been pulled from sale on the PlayStation Network and will disappear from Xbox Live Arcade at the end of next year, Eurogamer reports.
"Due to the expiry of the contract with Ferrari, OutRun Online Arcade will remain offline on PSN but will still be available on XBLA until Dec 2011," publisher Sega told the site.
OutRun Online Arcade was released in April 2009 on Xbox Live Arcade for 800 Microsoft Points ($10). The PlayStation Network edition was not released in North America.
A number of Midway titles were similarly pulled from Xbox Live Arcade earlier this year due to, in the words of Microsoft's Larry 'Major Nelson' Hyrb, "evolving rights and permissions." Those who had already purchased the games could still play and re-download them, as shall most likely be the case with OutRun Online.

That kind of clause makes it much more difficult to manage older IP rights that might have been secured 20 years back before the internet and especially digital distribution with lingering server based copies could have existed.
Yeah, it's real, and it is a headache for someone trying to manage a brand like Ferrari.
