X-Box Trademark Delay

A company in Florida is claiming to have rights to the X-Box name which you can read about in a few places. CNET, MSXBox , FT.com , and Eurogamer. Here is basically what is going on:
MS is being threatened with legal action by a small Florida-based company called Xbox Technologies, which filed a string of trademark and patent applications involving the word Xbox starting in March 1999, months before Microsoft picked it as the name of their console. If the court case goes ahead it could force Microsoft to rename their console or delay its launch.

I was just going over this in my head. Now while every magazine in the world thought DC was the greatest thing since sliced bread, it still failed horribly in the mainstream. That should be the #1 indicator that gamers like us that are "in the know", make up only a small percentage of the gaming community.
So just because you see every print mag or every pimple-faced store clerk singing praises about the X-box, does not mean that it will succeed in the long run.
To all the X-box fanboys visiting the PS2 board, tell me how the X-box could possibly acheive mainstream over the PS2 without using the following reasons:
1) Name recognition. Microsoft has the most recognized and despised names. They are thought of as a monopoly by the mainstream.
2) Better graphics. N64 AND DC had better graphics but still failed to make a dent in Sony's lead.
3) Better games. Hell, the majority of the games announced for the X-box are ports. The few that are exclusive have no mainstream appeal, yet. I like Malice, but I have seen kick-ass games like Rayman 2 DC sit on the shelves while crap games like Royal Rumble outsell it.
4) Marketing. You can't beat the master of marketing. It's what sony does best. I love it when I hear you fanboys talk about M$ good marketing. WHERE? I have never a TV or radio spot for a Microsoft product. And the only print ads I have seen are for the games.

Maybe this "holding company" is just a paper business that registered the name in anticipation of selling it to MS. Then again, Xbox isn't exactly a unique name.
